An absorbing mystery but I'm not sure about the legal basis for the plot. First, it sounds like a malicious prosecution, and/or an abuse of process, or obstruction of justice, on the part of the judge and prosecutors. Second, I doubt that a mistake as to the identity of the victim alone could get the prosecutor around the double-jeopardy problem.
